Real enforcement for vision plan rules

Beginning January 1, 2026, the Insurance Commissioner enforces the vision plan rules under Nevada's unfair-practice law. The Commissioner can investigate, hold hearings, seek court orders, and suspend or revoke licenses. Fines can be up to $5,000 per violation for companies, and up to $500 for licensed agents, brokers, solicitors, or adjusters.

Stronger rules for vision insurer contracts

Beginning January 1, 2026, vision insurers cannot control a provider's medical judgment or hire them to deliver covered care. They may not withhold or claw back payment if you were eligible on the service date. They cannot pay differently because of the lab, supplier, software, or association a provider uses. They cannot force a provider to join multiple plans, set prices for care the plan does not pay for, or require a specific lab or products they own. Before adding a provider to a network, the insurer must share the pay rates for each covered service.

Clearer vision plan disclosures and ads

Beginning January 1, 2026, vision insurers must clearly disclose any ownership or financial stake they have in suppliers or providers. Your vision provider must tell you in writing if they have a financial stake in a non-network lab or supplier, and note any rebate or rewards programs. Insurers cannot say they "cover" care when they only offer a discount or add extra copays or coinsurance.

When the new vision rules apply

The law takes effect January 1, 2026. Any vision plan delivered or renewed on or after that date automatically includes these protections. Plans and contracts in force on January 1, 2026 keep their old terms until they renew. The law also defines key terms like covered services, materials, enrollee, and provider so rules are clear.
