Committee guides sexual assault kit tracking

The Attorney General uses the Committee’s recommendation to choose the state office that runs the sexual assault kit tracking program. This replaces the former working group’s role.

More data sharing for domestic violence reviews

The Central Repository must give the Committee criminal-history records when it reviews a domestic-violence death. The Committee is added as an authorized recipient for those records. Review teams for domestic-violence deaths, child deaths, adult maltreatment, maternal deaths, and suicide can meet with and share information with the Committee when appropriate. These review bodies may ask a court for subpoenas for needed records, and their meetings and records stay confidential and closed to the public. Child-welfare agencies may share case information with those teams and the Committee. The State Board of Health allows use of death certificates and vital statistics for these reviews.

New fund for domestic violence programs

The state creates the Account for Programs Related to Domestic Violence and Sexual Assault. Fees collected under NRS 176.094 are deposited into this Account. The Ombudsman manages the Account and can spend only on listed items: Committee costs, training for police, attorneys and judges, victim assistance, public education, and the Ombudsman’s duties. The Committee may also accept gifts and grants and must deposit them in the Account for its work.

$35 fee for domestic violence convictions

If a court finds you committed an act of domestic violence under NRS 33.018, you must pay a $35 fee. The court clerk sends the money to the State Controller each month. The money goes into the state account for domestic violence and sexual assault programs.

Statewide victim custody alerts and rules

The Attorney General runs a statewide victim notification system with a toll-free phone line and a website. Victims and the public can sign up to get alerts when an offender’s custody status changes. The Domestic Violence and Sexual Assault Committee sets policies and oversees how the system runs. Police, Corrections, Public Safety, and the Parole Board must cooperate when funding is available. The Attorney General may use gifts, grants, and donations to operate the system. A missed notice does not create a right to sue the State.
