AN ACT relating to education; requiring a school administrator or his or her designee to conduct an initial screening and assessment of a report of discrimination based on race, bullying or cyber-bullying to determine whether to take certain actions; authorizing the board of trustees of a school district to assign a pupil who is a perpetrator of discrimination based on race, bullying or cyber-bullying to another school if his or her parent or guardian requests such an assignment; and providing other matters properly relating thereto.

Follow-up and community help for victims

For each reported victim, the administrator meets with the pupil within 10 school days to check well‑being and make sure the harm has stopped. The school also gives each parent a list of community resources that might help, including free or low‑cost options. Sharing this list does not require the school to provide those services.

Prompt parent notice and quick investigations

When an investigation starts, the school must tell parents of every pupil directly involved by phone, email, or in person. If the report comes during school hours, notice is due before the office closes that day; after hours or on a non‑school day, before the next school day’s office closes. The school interviews the pupils and their parents. It should finish within 5 school days, with up to 2 more for extenuating reasons. If contact info on file is wrong, a good‑faith attempt to reach you counts. Deadlines use your school’s calendar, and sexual assault cases have no time limit.

Faster reporting and screening at schools

School staff who see or learn about race-based discrimination, bullying, or cyber-bullying must report it the same day. The administrator must screen the report right away. If a violation looks likely, the school must stop it, protect the victim, and start an investigation. If the victim cannot be reached, action can wait until the next school day.

Investigation results and parent appeal rights

After the investigation, the school writes its findings. If a violation is found, it sends parents the report within 24 hours and recommends discipline that uses restorative practices and puts the victim’s safety first. If no violation is found, the incident is not added to the accused pupil’s record. Parents can appeal under school policy, then file a complaint with the Department within 30 days after the school’s response. If a violation is confirmed, the board may also assign the perpetrator to a different school, and must keep them out of the victim’s school if both are moved.

Monthly bullying reports from principals

Each principal sends a monthly report to their supervisor. It lists how many bullying, cyber‑bullying, and race‑discrimination reports the school received, and how many were violations or not.

New rules start July 1, 2025

These rules take effect July 1, 2025. Schools, staff, boards, and the Department follow them starting that date.
