AN ACT relating to waste; requiring certain owners of a distributed generation system to file certain plans relating to the disposal of the distributed generation system with the Division of Environmental Protection of the State Department of Conservation and Natural Resources; requiring facilities that recycle materials from a distributed generation system or utility-scale solar project to file a report with the Division; requiring a surplus retirement plan to include certain information relating to the retirement of a utility-scale solar project; and providing other matters properly relating thereto.

Clearer leases and disposal for home solar

Beginning January 1, 2028, the owner of a leased home solar system or power‑purchase system must file an end‑of‑life disposal plan with the state. The plan puts reuse and recycling first, names who will remove the system, explains how panels will be reused or recycled, and lists the expected recovery rate (generally aiming for at least 90% for recycled panels). Starting the same date, every home solar lease must give clear terms in at least 10‑point font: contacts, install timing, lease length and payments, warranties, and who must remove or dispose of the system under the plan. The lease must also say if state or federal incentives are built into your payment and who owns any tax, rebate, or energy credits.

Yearly reports from solar recyclers

Beginning January 1, 2028, Nevada recycling facilities that handle solar systems or components must file a report each year by March 1 for the prior calendar year. The report must show total material received, total material recycled, and the recovery rates.

Decommission plans for big utility solar

Beginning October 1, 2025, when an electric utility marks an asset as surplus, it must file a retirement plan within 120 days. For solar projects of 70 megawatts or more, the plan must list the landowner, explain how the project will be taken down and materials reused or recycled, give a schedule, and show how the land will be returned to a similar state. It must include estimated decommissioning and restoration costs and explain how the plan will be funded under state law.
