AN ACT relating to deceptive trade practices; requiring a person who does not hold a cannabis establishment license and who sells or offers to sell certain hemp products to display signs containing certain information; prohibiting such a person from making certain false, misleading or deceptive statements in advertising; making it a deceptive trade practice to violate those requirements or prohibitions; authorizing the Cannabis Compliance Board to investigate and refer violations of those requirements or prohibitions to the Attorney General; and providing other matters properly relating thereto.

Stronger enforcement against unlicensed cannabis sales

The Cannabis Compliance Board can investigate suspected violations of these hemp rules and refer cases to the Attorney General for penalties. The Board may also take action statewide against unlicensed cannabis activity. It can refer matters to state or local law enforcement, including the Department of Public Safety’s Investigation Division. The Board can educate the public about the risks and illegality and run a confidential reporting system. Under its regulations, it may impose penalties on people who operate or sell without a license.

New rules for unlicensed hemp sellers

If you sell hemp for people to consume and are not a licensed cannabis establishment, you must post two signs. At every customer entrance, post “THIS LOCATION IS NOT LICENSED TO SELL CANNABIS” in letters at least 1 inch high, lit and readable from 30 feet. At each sales station, post “ALL HEMP PRODUCTS CONTAIN LESS THAN THE LEGAL LIMIT OF THC” in nonitalic letters at least 3/8 inch high, between 3 and 7 feet off the floor. You may not advertise false or misleading claims about being licensed, being a cannabis business, or about a hemp product, including saying it is cannabis or that it causes an intoxicating effect. Breaking these rules is a deceptive trade practice under state law, and other consumer protection laws can also apply. The rules cover hemp products for human consumption and do not cover items that contain only an approved hemp component.
