New right-of-way rules for broadband providers

Beginning July 1, 2026, a broadband provider must sign an agreement with the local government before using the public right-of-way. Local governments must treat similar providers the same when making and enforcing these agreements. These rules apply whether or not the provider has a state utility certificate. The law does not block anyone from offering telecom service under federal law. It also defines “broadband service” (at least 20 Mbps in one direction), “broadband provider,” and “local government.”

Broadband access stays open until 2026

Upon enactment, local governments may start negotiating and signing right-of-way agreements with broadband providers. Until July 1, 2026, a local government cannot suspend, revoke, or deny a provider’s right-of-way access just because an agreement is not yet signed.

Cap and rules for local broadband fees

Beginning July 1, 2026, payments to a local government under a right-of-way agreement are capped at 2 percent of a provider’s annual gross revenue from broadband in that area. The payment can be a franchise fee, license fee, or similar charge. Local governments may collect these agreement-based fees even if other business license fees are limited by law.
