Clear rules for out-of-state child placements

The law requires any Nevada placement with someone who lives in another state to follow the Interstate Compact process. Foster agencies must check with the state licensing authority before agreeing to take a child moving from another state and confirm which compact applies. Placements that follow the Compact are not treated as child trafficking crimes. Families, agencies, and courts now use one set of steps for interstate placements.

Binding interstate rules, emergency powers, and fees

Interstate Commission rules are binding in Nevada. Anyone affected can ask a federal court to review a rule, usually within 60 days. The Commission can issue emergency rules that take effect right away, but normal rulemaking must follow within 90 days. It can enforce compliance, order fixes, and sue for court orders and damages, with attorney fees possible. The Commission can charge each member state an annual assessment to fund its work.

Nevada sets up and phases in compact

Nevada sets up a central Compact office, led by a director who serves at the Governor’s pleasure, to work with all agencies. The state also creates or designates an advisory council to coordinate across branches. The law uses staged start dates: some parts take effect on enactment to enter the Compact, and most duties start when at least 35 states have joined. When the new Compact is in force, the old Nevada compact law is repealed. Local governments may cover extra costs for this act without the usual NRS 354.599 limits.
