AN ACT relating to transportation; revising the minimum dollar amount of transportation network company insurance that a transportation network company, a driver or a monitored autonomous vehicle provider is required to maintain under certain circumstances; defining certain terms related to delivery network companies; providing that certain delivery network companies are not vicariously liable for any acts or omissions of a driver who provides delivery services for the delivery network company; providing that a transportation network company is not vicariously liable for any acts or omissions of a driver who provides transportation services for the transportation network company; and providing other matters properly relating thereto.

Ride-hail and self-driving insurance minimums

During an active trip, coverage is at least $1,000,000 per accident. This was $1,500,000 before. When a monitored self-driving vehicle is operating, it also must carry at least $1,000,000 per accident. When a driver is logged into the app but not on a trip, coverage is at least $50,000 per person, $100,000 per crash, and $25,000 for property damage.

Stronger protections against ride-hail coverage gaps

If a driver’s or provider’s policy lapses or is too small, the company must supply primary insurance that meets the law. Coverage can come from the company, the driver, the autonomous provider, or a mix. Qualifying ride-hail insurance counts as proof of insurance under state rules. A ride-hail insurer cannot require another insurer to deny a claim before it pays.

Rules for ride-hail insurance and claims

Ride-hail insurers must defend and indemnify covered drivers, providers, and the company on covered claims. Policies may include extra coverages like medical payments, uninsured motorist, comprehensive, or collision. If a car with a loan has a collision or comprehensive claim, payment goes to the repairer or jointly to the owner and lender. Providing ride-hail insurance does not make the company the vehicle owner.
