State pays indigent postconviction costs, attorney fees

If the court finds you are indigent in a postconviction habeas case, the state pays all necessary court costs and reasonable lawyer fees. The money comes from the Department of Indigent Defense Services. If that money runs out, the state uses the Reserve for Statutory Contingency Account. These payments come from the state, not county funds. After counsel is appointed, your lawyer can file extra papers within 30 days after the court orders a response or after appointment, whichever is later. If the State has not already responded, it must respond within 15 days after getting those papers. If the State moves to dismiss, you must respond within 15 days. No other pleadings may be filed unless the court orders them.

When new funding rules start

Sections 1 and 2 take effect now only for rulemaking and prep work. For all other purposes, they take effect on July 1, 2025.
