Blood tests after fatal crashes

Beginning July 1, 2025, coroners must cause a blood sample to be drawn from anyone who dies from a motor vehicle crash. A licensed lab must test for alcohol and commonly misused drugs. Results are public records and must be sent to the Department of Public Safety as soon as the coroner gets them. The old 8-hour draw rule and 30-day reporting window are removed.

Faster electronic crash reporting statewide

Beginning July 1, 2025, police who investigate reportable crashes must file an electronic report with the Department of Public Safety within 10 days of the crash, or within 10 days of a related death. Sheriffs, police chiefs, and the Highway Patrol must immediately file copies of any required crash reports they receive. The Department of Public Safety sets the detailed report form and makes it available to agencies. As soon as practical after DPS receives a report, it must send a copy to the DMV. DPS and the Department of Transportation must also build and maintain a central statewide electronic crash data repository.
