Stronger enforcement of insulin cap rules

Nevada’s Insurance Commissioner can require Nevada standards, including the $35 insulin limit, for some policies sold to nonresidents when the other state declines oversight. The Commissioner may also suspend or revoke an HMO’s license if its coverage or charges do not follow the law, including the insulin cap.

Some public plans are exempt from cap

The $35 insulin cap does not apply when HMOs serve Medicaid or CHIP members under state contracts, members of the Public Employees’ Benefits Program, or some local‑government employee plans. These carve‑outs only apply under those public contracts. For other HMO or plan contracts, the cap still applies.

Insulin copays capped at $35 per 30 days

The law caps what you pay for insulin at no more than $35 for a 30‑day supply. It applies to most private health plans, including individual, group, HMO, hospital/medical service, benefit society, and prepaid limited service plans that cover insulin. The cap applies to any insulin type and amount used to treat type 1, type 2, or gestational diabetes. Beginning October 1, 2025, new policies must follow this rule; older policies follow it when they renew or extend. Plans may still use normal deductibles and copays for other diabetes care, but the insulin part is capped at $35 per 30 days.
