AN ACT relating to guardianship; revising provisions relating to certain investigative services provided during a guardianship proceeding; prohibiting a governmental entity from charging a fee for providing a copy of certain documents relating to a guardianship proceeding; revising provisions relating to service of process of a citation and petition in a guardianship proceeding; changing the name of the State Guardianship Compliance Office to the State Guardianship Office; changing the title of the State Guardianship Compliance Officer to the State Guardianship Officer; revising the powers of the Officer; authorizing a court to appoint or extend the appointment of a guardian for a protected minor or proposed protected minor seeking status as a special immigrant juvenile with the United States Citizenship and Immigration Services of the Department of Homeland Security under certain circumstances; revising certain notice requirements for minor guardianship proceedings; and providing other matters properly relating thereto.

Clearer service and notice in guardianships

Beginning July 1, 2025, service of a citation and petition must meet new timelines. For adults and for minors age 14 or older, personal service must be at least 10 days before the hearing, or a court‑approved alternative at least 20 days before. Other required people must get certified mail 20 days before, personal service 10 days before, or a court‑approved alternative 20 days before. If people cannot be found after due diligence, the court can require publication at least 20 days (10 days for some minor notices) before the hearing unless waived. In minor cases, the petitioner must give 10 days’ notice to the minor age 14+, a parent or guardian if under 14, known close relatives, care providers, and anyone who asked for notice, and must file proof of notice before the hearing.

Guardianship help for immigrant youth to 21

Beginning July 1, 2025, a court may appoint or extend a guardian of the person for an unmarried minor who is seeking Special Immigrant Juvenile (SIJ) status, if the minor consents. The guardian cannot override the minor’s choices on medical care, school, or where they live without the minor’s clear consent. For SIJ cases, the law treats a person under 21 as a minor for guardianship and ends that guardianship at age 21 unless the minor ends it earlier. The law also treats a person under 19 as a minor if a court already continued a guardianship so the youth can finish high school.

New State Guardianship Office for oversight

Beginning July 1, 2025, Nevada creates the State Guardianship Office. The Nevada Supreme Court appoints the State Guardianship Officer and sets the salary within money the Legislature provides. The Officer can hire accountants and investigators to audit and investigate guardianship cases. The Officer cannot serve as a guardian.

Stronger guardianship investigations and lower fees

Beginning July 1, 2025, courts can appoint investigators in adult and minor guardianship cases. Investigators find services, check allegations, assess a proposed guardian’s ability to meet basic needs, locate close relatives, and get vital records. Investigators file reports with the court. In adult cases, reasonable pay for investigators can come from the proposed protected person’s estate. The court may also make a person who caused an unnecessary investigation pay the costs. State and local governments cannot charge copy fees when investigators request documents, including investigators from the State Guardianship Office.
