New key rules and worker checks for large landlords

Landlords of large apartment complexes must run a criminal background check before hiring for any job that can access unit keys. They must keep written rules on how keys are stored, issued, returned, secured, used, and deactivated. They must also keep a log on site for every key issued and returned, and keep those written policies on the property. These duties apply only to properties that meet the law’s size thresholds.

You can sue landlords who break these rules

If a landlord of a covered property breaks these rules, a person harmed or a district attorney can sue. The court can order the landlord to stop, award actual damages, and make the landlord pay reasonable attorney’s fees and costs. The court can also grant other legal or fair relief.

Which properties and keys the law covers

These rules apply only to certain properties. In counties with 100,000 or more people, they cover properties on one parcel with more than 50 units. In smaller counties, they cover properties on one parcel with more than 30 units. A dwelling unit key includes any physical or electronic way to enter a unit, like a code. Banks and licensed real estate brokers and salespeople are not treated as landlords under this section.
