Faster Medicaid coverage for pregnant patients

Beginning January 1, 2026, Nevada hospitals that provide birthing care must screen every pregnant patient for presumptive Medicaid. Each hospital must enroll as a qualified provider or contract with a qualified entity to make these decisions. If you are found presumptively eligible, the hospital must give written dates for your coverage period, a summary of Medicaid benefits, and how to apply for full Medicaid. If you are not presumptively eligible, the hospital must explain why and give information on how to apply. If your baby is born premature, with low birth weight, or with another condition that may qualify for SSI, the hospital must give parents written notice that the child may qualify for SSI and Medicaid. All notices must be in your primary language; if no written translation is available, the hospital must give the notice verbally in your language and record it in the medical file.

New NICU rights for parents

Beginning January 1, 2026, parents and legal guardians of newborns in a Nevada hospital NICU have clear rights. You get timely, clear updates on your baby’s condition and plan. You may join daily rounds and help make decisions, except in emergencies or when safety requires otherwise. You must be told about and consent to non-emergency treatments. You may hold and touch your baby when medically appropriate. Hospitals must offer lactation support and, within their capabilities, safe storage for breast milk. They must share mental health resources, respect reasonable cultural or religious requests, and guide you on discharge planning, long-term needs, and applying for private insurance, SSI, and Medicaid. Nevada can deny, suspend, or revoke a hospital’s license if it violates these NICU rights. These rights can be limited only for emergencies, safety, medical appropriateness, or feasibility.
