AN ACT relating to cannabis; revising requirements for the packaging and labeling of cannabis and cannabis products; revising the definition of “usable cannabis”; authorizing an agent of the Cannabis Compliance Board to issue a hold order for cannabis or a cannabis product only under certain circumstances; requiring the Board to adopt regulations governing hold orders; authorizing a cannabis cultivation facility and a cannabis production facility to engage in certain activities; requiring the Board to develop and maintain certain checklists; requiring the Board to post certain information on its Internet website; revising requirements concerning the amount of usable cannabis and THC that may be contained in a single package of cannabis or cannabis products; imposing requirements concerning a single package of an infused pre-roll; and providing other matters properly relating thereto.

Tighter cannabis advertising rules and fines

Ads cannot be false or target youth or run where 30% or more of the audience is under 21. Ads must include required warnings and a license ID. Local rules can be stricter. Fines escalate: $1,250, then $2,500, $5,000, and $10,000 within two years.

Clear labels and child-safe packaging

Cannabis packages must show THC in milligrams and state it contains cannabis and was potency tested. Packaging and marketing cannot use cartoons or look like kids’ candy. Stores must give safety warnings, use opaque child‑resistant exit packaging, and offer lockable storage containers. Only people 21 or older may enter.

Hemp and CBD sales allowed

Producers may sell hemp‑made products to cannabis stores. Stores may sell hemp products and CBD items with no more than 0.3% THC. The Board may allow other products by regulation.

THC serving and package limits

Adult‑use sales and rules use THC concentration, not just weight. Edibles must list the number of servings; each serving is no more than 10 mg THC. A single package can hold at most 2.5 ounces of usable cannabis. Package THC limits: concentrates 3,500 mg; capsules 100 mg each and 1,000 mg per pack; tinctures 1,000 mg per pack. Edibles 100 mg per pack; topicals up to 6% THC or 2,500 mg per pack; suppositories or patches 100 mg each and 1,000 mg per pack; other products 1,000 mg per pack. Each sale must be in one package. Infused pre‑rolls are defined and may weigh up to 7 grams. Usable cannabis excludes seeds, stalks, and roots.

Demographic reporting for owners and workers

The Board collects race, ethnicity, age, and gender for each owner, manager, and registered agent. The Board sends this data to the Legislature every odd‑numbered year.

More activities for cannabis producers

Adult‑use producers may package and sell usable cannabis to retail stores. Medical producers may package and sell usable cannabis to medical dispensaries. Cultivation and production facilities may sell seeds, branded merchandise, and cannabis supplies in or out of Nevada. They must follow Nevada rules and the destination’s laws, and cannot ship where it is illegal.

Cleaner and safer production practices

Production facilities must seal cookies and brownies in non‑transparent containers. They must have a separate hand‑wash area. Workers must restrain hair, wear clean clothes, and keep nails trimmed. All cannabis products must be packaged on site.

Two cannabis statutes repealed

The law repeals NRS 678C.100 and NRS 678D.040. Those sections are removed from Nevada’s cannabis statutes.

Stronger Board enforcement and consistency

Board agents can place hold orders on risky products. Holds end within 30 days unless extended after a hearing. The Board sets when holds apply, notice, investigations, and how retesting can lift a hold. Board employees must complete standard training and certification before inspections, investigations, or audits. The Board sets rules to investigate and penalize unlicensed activity, including citations, fines, and law‑enforcement referrals. The Board must publish approval checklists and post and update FAQs each quarter and after trainings.
