AN ACT relating to industrial insurance; requiring a firefighter who is not employed by the Executive Department of the State Government or volunteer firefighter to submit to an annual cancer screening for certain industrial insurance coverage for cancer; revising provisions governing the administration of physical examinations required of certain firefighters, arson investigators and police officers who are not employed by the Executive Department of the State Government for certain industrial insurance coverage for lung disease and heart disease; and providing other matters properly relating thereto.

Yearly firefighter cancer checks, employer-paid

Beginning July 1, 2026, covered firefighters and covered volunteer firefighters get a cancer screening at hire or when coverage starts, and every year after. Employers must pay for these screenings. The screening includes a skin exam; a mammogram for women 40+; a pap smear for women; a PSA and testicular exam for men; thyroid check; urine dipstick; fecal occult blood test; and a colonoscopy at 45+ if none in the last 10 years. A woman can skip the mammogram or pap with written proof from her doctor or clinic that it was done or not needed within the last 12 months. The on-hire screening rule does not apply to Executive Department employees.

Easier heart and lung claims for responders

Beginning July 1, 2026, if you worked two or more continuous years full‑time as a firefighter, arson investigator, or police officer, heart and lung diseases are conclusively treated as work‑related when diagnosed during employment and within certain post‑employment windows. For volunteers with five or more continuous active years, heart disease from extreme overexertion in danger is covered. Separated workers can lose the lung presumption if they used tobacco frequently in the prior year or did not follow a doctor’s plan in the previous three months.

Penalties and bills paid during appeals

Beginning July 1, 2026, if you win an appeal on a denied lung or heart claim, the Administrator may order up to $200 per day paid to you from the day you filed the appeal to the final decision. If you request a hearing, the employer or insurer must pay medical bills from the hearing request date until the final decision. If the employer or insurer wins in the end, they can recover amounts paid. The Administrator also reviews any such appeal that lasts more than six months to find the cause of delays.

Stronger job physicals for fire and police

Beginning July 1, 2026, non‑Executive employees’ required physicals add a full test list: hearing, TB screening, full systems exam, broad blood labs, spirometry, chest X‑ray, heart tests (ECG, stress test if 40+ or abnormal, and coronary calcium at 40+), and vision. When possible, exams are done by a Nevada‑licensed physician or advanced practice nurse who knows fire and police work. Workers covered for lung disease get a physical at hire or coverage start, then every two years until age 40, and yearly after; Executive employees must include lung function testing and an X‑ray. Employers must pay for these required tests. Volunteer departments must mail exam notices at least 10 days ahead; missing a scheduled exam can end benefits, and applicants 50+ may pay up front but are reimbursed if declared fit and appointed.

Local governments exempt these added costs

Beginning July 1, 2026, extra costs that local governments face from this law are exempt from NRS 354.599. This changes local budget rules but does not set new charges on households.
