Reporting and audit rules for rental companies

Beginning July 1, 2025, rental companies that charge the recovery fee must file a report each year by August 15. The report must show the total recovery fees collected and the property taxes on the equipment for the prior fiscal year. Companies must keep related records for at least 5 years, make them available during business hours, and follow any record rules the Department issues. The Department can examine books and records to check reports or compliance. Intentionally false reports or keeping fake books is a gross misdemeanor. The law uses the 2022 NAICS codes when classifying businesses.

Up to 2% fee on heavy equipment rentals

Beginning July 1, 2025, heavy equipment rental companies in Nevada can add a separate recovery fee up to 2% of the rental charge. The rental charge excludes separately stated delivery, installation, financing, taxes billed to you, and the recovery fee itself. The fee applies to rentals of listed construction and industrial equipment without an operator, for terms up to 365 days or with no end date. Government renters and other entities Nevada cannot tax cannot be charged this fee. Companies must list the fee on the invoice, keep the money in a separate account, and use it only to offset property taxes on this equipment.
