Stricter licensing for pari‑mutuel operators

You cannot run pari‑mutuel wagering unless you secure all required federal, state, county, and city licenses and approvals. An operator of a system must register with the Board as a service provider before acting. The Commission licenses and registers interactive gaming service providers, and system operators count as service providers. Employees and temps of these operators are treated as gaming employees and are regulated.

New 3% tax on wagers

Licensees must pay a 3% tax on the total money wagered on races, sports, and other events. The tax is paid to the Nevada Gaming Commission each quarter. Plan for this cost based on your wagering handle.

Off‑track commissions set; promos limited

The Commission sets the total commission taken from off‑track wagers and can divide it among approved participants. Licensed off‑track operators cannot take less than face value, give refunds or rebates, or pay bonus payouts, unless exempted by Commission rule. Tracks may sell live broadcasts at the same rate to all users, except for broadcasts tied to off‑track wagering agreements.

Only bet at approved locations

It is illegal to bet on licensed races or events outside the approved enclosure or establishment. Place bets only at locations the law allows to avoid legal trouble.

Civil immunity for gaming regulators

Nevada, the Gaming Commission, the Control Board, and the Off‑Track Committee and their staff have civil immunity for good‑faith actions under this law. It is harder to sue these agencies for such actions.

Gaming license rules and renewals updated

The law narrows who counts as a gaming licensee and which payments are treated as license fees. It removes some cited statutes from renewal payment rules and from how prepaid fees are credited, and narrows which unpaid fees can trigger penalties. It also repeals several listed gaming statutes, updating the legal framework.

New Off‑Track Wagering Committee

The Commission appoints an 11‑member Off‑Track Pari‑Mutuel Wagering Committee from licensed operators across revenue tiers. The Commission gives this committee the exclusive right to negotiate deals with out‑of‑state pools and registered system operators.
