AN ACT relating to fire protection; revising the duties of the State Forester Firewarden; revising the composition of the State Fire Marshal Division within the Department of Public Safety; expanding the list of facilities for which the State Fire Marshal is required to enforce laws and adopt certain regulations to include cannabis production facilities; eliminating the requirement that the State Fire Marshal cooperate with the State Forester Firewarden to mitigate the risk of certain fires; revising provisions relating to the investigation of certain fires by the State Fire Marshal to include a fire that results in an injury or certain financial losses; and providing other matters properly relating thereto.

New fire rules for cannabis sites

The State Fire Marshal now sets and enforces fire safety rules for cannabis production facilities defined in NRS 678A.125. Rules cover fire prevention, building access for responders, and safe, adequate exits. Owners may face new compliance and retrofit costs to meet these standards.

More state probes of major fires

The State Fire Marshal must investigate any fire that causes an injury or death, losses over $2,000,000, or is suspicious. In counties with fewer than 100,000 people and not a consolidated municipality, these probes happen automatically. In counties with 100,000 or more people, or consolidated municipalities, the Marshal investigates only if the local fire chief asks.

More wildfire help for communities

The State Forester Firewarden must work with agencies and property owners to find and reduce wildfire risks. The Forester provides technical help to restore resilient landscapes, build ignition-resistant communities, and improve wildfire response.

State ends required wildfire coordination

The law removes the duty for the State Forester Firewarden and the State Fire Marshal to work together on vegetation fire rules and enforcement. Both agencies keep their other powers and duties. This may reduce coordinated action to prevent vegetation-driven wildfires.

Flexible structure for Fire Marshal Division

The State Fire Marshal Division remains in the Department of Public Safety. The law removes the fixed list of its internal sections. The agency can reorganize its sections as needed.
