New wildfire smoke rules for outdoor workers

Beginning January 1, 2026, covered Nevada employers with outdoor workers must follow wildfire smoke protections. Employers must monitor air and reduce exposure when the Air Quality Index (AQI) is 150–199, and use stronger steps at 200 or more. Regulations set an AQI from wildfire smoke when critical outdoor tasks must stop. Employers must have a system to alert workers during a shift when AQI is 150+ and to accept reports of exposure or symptoms, and must provide clear training on risks and protective gear. Exempt: mine operators, employers of commercial truck drivers, emergency services, and employers with 10 or fewer workers. The state can issue guidance, and these rules do not add employer liability under workers’ comp or occupational disease insurance.

Local governments’ costs excluded from rule

Local governments treat extra costs from this law outside a state budgeting rule (NRS 354.599). This change takes effect upon passage and approval. It affects local budgets and does not give money directly to households.
