Advance notice and paid time for peace officers

Agencies must give a peace officer who is the subject of an investigation under NRS 289.057 written notice at least 48 hours before any interview or hearing. The notice must describe each allegation with specific acts and dates, times, and places (or state if unknown), list the interview details, name all participants, and include the NRS 289.080 rights statement. Officer witnesses also must get at least 48 hours’ notice that they must appear and be interviewed, and they may bring a representative; any witness may waive the notice. Agencies must hold interviews during regular hours when reasonably practicable or change schedules so the time counts and is paid at regular wages. If an officer must appear off duty, the agency must pay the officer for appearing and any benefits owed.

Stronger interview protections for peace officers

Right before an interview or hearing, the agency must say on the record that the officer must answer and that not answering may lead to insubordination charges. If the officer answers after that warning, those compelled statements cannot be used against the officer in a later criminal case. Questions must stay within the alleged misconduct; if new possible misconduct appears, the agency must stop and issue a new notice before asking about it. During any interview or hearing, the officer (subject or witness) may explain answers or refute negative inferences.
