AN ACT relating to insurance; requiring certain insurers to allow certain persons who are less than 65 years of age to purchase a Medicare supplemental policy that the insurer makes available for purchase to new insureds who are 65 years of age or older; imposing certain restrictions on the limitations, terms and conditions such an insurer may impose and the premiums such an insurer may charge for such policies to persons who are less than 65 years of age; requiring such an insurer to establish certain open enrollment periods for the purchase of a Medicare supplemental policy; prohibiting an insurer from imposing an exclusion of certain benefits with respect to a Medicare supplemental policy issued during an open enrollment period; and providing other matters properly relating thereto.

Medigap access and price caps under 65

If you are under 65 and on Medicare because of disability or ESRD, you can buy any Medigap plan sold to new 65‑year‑olds in Nevada. Your open enrollment starts the first day of the first month you enroll in Medicare Part B and lasts at least six months. During that time, insurers cannot deny you, limit your coverage, or exclude preexisting conditions. They must give you the same terms as 65‑year‑olds. For standardized plans A, B, or D your premium cannot be higher than a 65‑year‑old’s; for other plans it cannot be more than 200% of that premium.

One-time 2025–2026 Medigap enrollment window

From October 1, 2025 through April 1, 2026, people under 65 on Medicare Part B due to disability or ESRD as of October 1, 2025 get a one‑time Medigap open enrollment. Any insurer that offered a Medigap plan in Nevada on October 1, 2025 must accept applications during this window. Insurers cannot deny you or exclude preexisting conditions for policies issued in this window. For this window, local government self‑insured plans and the Public Employees’ Benefits Program count as insurers and must follow these rules.

Public and nonprofit Medigap plans must comply

Nonprofit hospital and medical or dental service corporations must follow the same Medigap access and protection rules as insurers. Local governments that offer group coverage through self‑insurance funds must also follow these rules. If the Board provides health coverage through self‑insurance, it must comply like a licensed insurer.

Annual birthday-month window to switch Medigap

If you already have a Medigap policy, you get an annual open enrollment starting on the first day of your birthday month and lasting at least 60 days. You can switch to any plan sold in Nevada with the same or fewer benefits than your current plan (ignoring innovative benefits). During this window, insurers cannot deny coverage, charge different prices, or exclude preexisting conditions. Your insurer must send you a notice 30 to 60 days before the window with the dates, your rights, and any benefit or premium changes. Insurers and agents must pay commissions for these sales the same as for renewals.
