Fines for improper senior referrals

Starting October 1, 2025, making certain improper referrals brings big fines. Referring someone to an unlicensed facility, to care that is not right for their condition, or to a facility you own can be penalized. The first offense can cost up to $10,000. Later offenses must be at least $10,000 and can be up to $20,000. The Attorney General recovers these fines, which go into a state fund to run these rules and protect patients.

New rules for senior referral agencies

Starting October 1, 2025, senior living referral agencies must register with the Division of Public and Behavioral Health. The application must list a U.S. street address where records are kept, contact details, proof of required liability insurance, and a fee up to $2,708. Registration lasts two years; renewal needs proof of insurance and a fee up to $1,354. Agencies no longer need a State Board of Health license, and the Board cannot raise these fees above the caps. The Division can deny, suspend, or revoke a registration, and it must give notice and appeal rights; in urgent health risks, it can suspend right away. Agencies may keep operating without a license or registration until 120 days after the new rules are adopted and approved. The Division must adopt regulations to run this system.

Starting October 1, 2025, adult day care facilities must make complaint summaries, investigation reports, and any disciplinary actions public when the Division provides them. Families and caregivers can see these reports to check a facility’s track record.
