Lower BAC means stricter DUI steps

The law lowers the key alcohol level to 0.16% (0.16 gram per 100 mL blood or per 210 liters of breath). If you are convicted of certain DUI offenses and your level is 0.16% or higher, the court must order an alcohol or drug use evaluation. At 0.16% or higher, you also cannot use the court’s treatment program available for some DUI cases.

More jail for second DUI

For a second DUI within 7 years, the minimum jail or residential confinement is now 20 days, up from 10. The maximum stays up to 6 months. This raises the least time you must serve if convicted.

Tighter repeat-offender DUI rules

If you are in a court-ordered DUI treatment program, that case still counts as a prior offense within 7 years. A later DUI can then bring tougher sentencing based on that prior. You also cannot apply again for the court’s treatment program if you were ordered to complete it before or if you have certain serious prior DUI crimes, including DUI-related felonies and homicide from DUI.

Old DUI statute section repealed

The law repeals section 484C.040 of Nevada law. That section no longer applies. Effects depend on how other DUI rules used it; no new fees or benefits are set here.
