New checks for no-bid service contracts

Before the State awards a no-bid service contract, it must do market research, write a justification report, and post a notice online for at least 11 days. Anyone can object within 11 days of the posting, and must state they can provide the services. Within 20 days of an objection, the Administrator must cancel and require competition or post a public reason to keep the no-bid award. If your objection fails, you can appeal under NRS 333.370. Each year by October 1, the Administrator sends lawmakers a compilation of all no-bid reports and objections from the prior fiscal year, and in even-numbered years also sends it to the Audit Subcommittee.

Longer state contracts with guardrails

State solicitations and ads for supplies, materials, equipment, and services can now run up to 10 years. Pre-planned extensions are allowed if they were in the solicitation and the Administrator finds they are in the State’s best interest. After the original term and any such extension, the Administrator may approve one more extension of up to 4 years, must find it is in the State’s best interest, and must order a competitive process before that extension ends. If an agency does not follow that order, the Administrator may allow another extension but must report to the Legislative Commission, and the agency head must appear to explain. The Administrator must adopt regulations to carry out these rules. The act also exempts its new legislative reporting requirements from NRS 218D.380.
