Pricing caps and 30% work by prime

Beginning July 1, 2025, the selected team must use open‑book pricing when the design is far enough to set a final cost. Contracts must set a maximum total payment, a cap for professional services, and a completion date or time. If talks fail, the Department ends negotiations and may hire a qualified team member for design or start a new procurement, and it may refuse bids from the original team. The winning team is responsible for the project, and the prime contractor’s workforce must build at least 30% of the work.

Bidding rules for I-80 design-build

Beginning July 1, 2025, the Department posts the project solicitation on its website with the scope, cost estimate, deadlines, and evaluation weights. Proposals must show qualifications, past performance, plans for preconstruction and construction, technical approach, and a pricing method that follows state law. Applicants must be able to get required bonds and insurance, hold Nevada licenses, have a qualified prime contractor, and disclose certain past breaches or disqualifications. Professional engineers on the team carry professional liability insurance up to $1,000,000 in total. Your submissions stay confidential until award or contract signing, and the Department must not release your financial or proprietary data before those times.

I-80 East upgrades use design-build

Beginning July 1, 2025, the Nevada Department of Transportation can use a progressive design‑build process for I‑80 East. The work covers the stretch between Vista Boulevard in Sparks and USA Parkway in Storey County. The Department selects a team and signs contracts for preconstruction, final design, and construction under the new procedures.

Transportation Department can hire oversight consultant

Beginning July 1, 2025, the Department may hire a registered architect or licensed engineer as a consultant to help oversee preconstruction and construction. The consultant cannot perform any construction work on the project and cannot take overall responsibility for completion.

Stronger contract protections for designers

Beginning July 1, 2025, contracts with design professionals must set payment timing, dispute steps, and late‑payment penalties. The prevailing party in an enforcement action gets reasonable attorney’s fees. Designers cannot be forced to defend or indemnify the prime for the prime’s own negligence, but they may owe indemnity for their own negligence. If a designer is found liable, attorney’s fees to the prime match the designer’s share of fault.
