Guardianship cases must consider other options

The law defines less restrictive options, like durable powers of attorney and supported decision-making, and requires courts and filers to consider them. A guardianship petition must say if the person already has a health or financial power of attorney or named a guardian, and confirm they got info about other options. A licensed physician must assess the person’s limits, how they affect safety and basic needs, and whether alternatives would work. Guardians’ reports must explain why alternatives are not used. People proposed for or under guardianship have a right to be taught about these options. The law uses the standard Nevada meaning of power of attorney.

ID now required in guardianship petitions

Guardianship petitions must include ID for the proposed protected person and the proposed guardian. Accepted ID includes a Social Security number, taxpayer ID, driver’s license or state ID, passport, permanent resident card, or tribal ID. If not filed at first, it must be given to the court within 120 days after a guardian is appointed or sooner if ordered. The court keeps these identifiers confidential.

New rules to change or move guardianship

To end or change a guardianship, the filer must prove it by clear and convincing evidence. They must show it is in the person’s best interests or that the person now uses a less restrictive option. To transfer a case to Nevada, the petition must show the person is in Nevada or will move here and that less restrictive options were considered, with reasons they are not reasonable. Nevada can deny a transfer if those alternatives were not considered.
