Bill Overview

Analyzed Economic Effects

2 provisions identified: 1 benefits, 0 costs, 1 mixed.

Tougher penalties for prison staff sexual misconduct

The law raises penalties on prison employees, contractors, and volunteers who abuse prisoners. Sexual abuse is a category B felony with 1 to 10 years in state prison. Unauthorized custodial conduct, like mouth-to-body contact, touching clothed genitals, exposing genitals, or asking for such acts, is a category C felony. Sexual abuse also covers intercourse and other sexual contact, and voyeurism such as watching a prisoner change or shower, requiring exposure, or taking images of private areas. Acts done to carry out official duties are not included. There is no separate crime for attempting unauthorized custodial conduct.

Stronger prison contraband and drug rules

The law bans giving or trying to give prisoners weapons, fake guns or bombs, drugs, or intoxicants. Leaving these items where a prisoner can get them counts as furnishing. If weapons, explosives, fake guns or bombs, or controlled drugs are involved, it is a category B felony with 1 to 6 years in prison and up to a $5,000 fine. If the item is an intoxicant, it is a gross misdemeanor. Intoxicant includes alcohol, synthetic cannabinoids, controlled substance analogs, and other chemicals used to get high. Prisoners who possess a controlled substance without authorization, or any marijuana or marijuana gear, commit a category D felony, even with a medical cannabis card.
