Bill Overview

2 provisions identified: 1 benefits, 1 costs, 0 mixed.

Parents protected for mental-health placements

The law says you are not abusing or neglecting a child just because you try to admit them to a mental health hospital when their behavior puts the family at risk. You are also not treated as abusive or as injuring a child’s health just because you bring a biological, foster, or adoptive child with those behavioral health needs into your home. These protections apply only when that single action is the only reason claimed. The same rule applies to criminal child‑abuse charges based only on those actions.

Clear duty to stop known child abuse

If you are responsible for a child, you must act. Doing nothing when you know or should know about abuse or neglect counts as allowing it.
