AN ACT relating to industrial insurance; authorizing an injured employee with a claim for an occupational lung disease or occupational heart disease to seek treatment or services from a physician or chiropractic physician which is not on the panel of physicians and chiropractic physicians maintained by the Administrator of the Division of Industrial Relations of the Department of Business and Industry under certain circumstances; setting forth certain requirements for the reimbursement of the costs for such treatment or services; providing for a penalty for failure to comply with those requirements; authorizing certain notices and other documents required in certain hearings or appeals relating to industrial insurance to be provided by means of an electronic filing system; and providing other matters properly relating thereto.

Fast payback for out-of-panel care

You or your health or casualty insurer can pay first for approved out‑of‑panel care and request payback. The insurer or employer must fully reimburse within 30 days of a proper request that lists who was treated, what care, who paid, and the cost. If they miss the deadline, the Administrator orders payment equal to twice the unpaid amount. Usual fee‑schedule or contract payment and recovery rules apply if payment is denied. Providers generally cannot bill you for work‑injury care; breaking the billing rules can mean fines up to $250 per violation. These changes apply to claims filed on or after October 1, 2025.

Choose a doctor outside the panel

If you file a claim for an occupational lung or heart disease, you can pick a doctor outside the state panel. This applies when the panel has fewer than 12 doctors in your specialty who take new patients and none can see you within 30 days. You may choose any doctor in that field who is contracted with a managed‑care group, is in‑network under a health plan, or contracts with your employer’s insurer. When you request the claimant statement in writing, the insurer includes a form that explains this right. These changes apply to claims filed on or after October 1, 2025.

Electronic filing for workers’ comp cases

Hearings and appeals in workers’ compensation may use an approved electronic filing system for notices and documents. The system must follow Nevada Supreme Court e‑filing rules. Mail or personal service still works. These changes apply to claims filed on or after October 1, 2025.
