New witness rules for adoption consent

Beginning July 1, 2025, Nevada updates the rules for consenting to a specific adoption. Your consent must be in writing and identify the child by name (if any), sex, and date of birth. You must sign and have your signature acknowledged like a property deed, and name who you authorize to adopt the child. The consent must say whether you have reason to know the child is an Indian child, and you must tell the court if that changes before the adoption order. Two competent, disinterested witnesses must sign in your presence. If neither the petitioner nor a spouse is related to the child within the third degree, one witness must be a social worker or caseworker from a child welfare or Nevada-licensed adoption agency. A comparable public or authorized adoption agency in another state also qualifies, including when the parent lives in that state.
