Bill Overview

Analyzed Economic Effects

4 provisions identified: 2 benefits, 0 costs, 2 mixed.

24/7 driving privilege for participants

If a court assigns you to the 24/7 sobriety program and tells the DMV, the DMV issues you a 24/7 driving privilege. You can drive to any destination while you stay in and follow the program. If you break program rules, the court must tell the DMV to revoke your privilege. This replaces the old restricted license for people in the program.

Clearer testing rules and sites

The program can use tests approved by the state or by federal 24/7 rules. If local rules require in-person testing, each site must offer at least two test times every day, about 12 hours apart if there are only two. Law enforcement may use outside providers to run testing, but those providers cannot decide who must join the program.

Lower minimum jail time

If you join the program, follow the rules for the time set by the court, and are later convicted, the minimum jail time is 5 days. This applies to the sentencing path tied to program participation and compliance.

Start date depends on DMV

The law takes effect when the DMV Director tells the Governor and the Legislative Counsel Bureau the DMV has enough resources. New licenses and program rules start after that notice.
