AN ACT relating to public utilities; requiring the Public Utilities Commission of Nevada to adopt regulations governing the filing of an application for the establishment of an alternative rate-making plan by a natural gas utility; setting forth certain requirements for the submission and approval of such an alternative rate-making plan; revising certain provisions relating to the application and approval for an alternative rate-making plan by an electric utility; and providing other matters properly relating thereto.

Stronger bill protections and refunds for gas customers

If a plan lets a utility recover capital costs, the utility must prove the spending was prudent. If the Commission later finds it was not, the utility must refund the amounts it collected from customers. For plans that use formula rates or last several years, the plan must include earnings-sharing and show how risk changes affect the allowed return and customer bills.

Faster timelines and public input on gas plans

After the Commission issues rules, a gas utility can apply during a general rate case or within 6 months after approval. Before deciding, the Commission must hold a consumer session in each major area the utility serves. The Commission must approve or deny within 210 days, with up to 90 more days for good cause; missing these limits means the plan is denied. If a plan is approved with changes, the utility has 30 days to accept or reject it. If it rejects, the request is withdrawn and either the concurrent general rate case rates take effect or the prior rates stay in place.

New rules for gas utility rate plans

The law sets a clear framework for alternative rate plans for natural gas utilities. The Public Utilities Commission must adopt rules on what plans can include, what to file, and how to inform customers. The Commission can approve plans only if they are in the public interest, create just and reasonable rates, and protect customers. It may refuse plans that do not meet its standards and can later investigate and change rates to keep them fair. Plans can include earnings-sharing and other terms the Commission finds reasonable, and some normal filing steps do not apply to these plans.
