State backstops missed pension payments by agencies

If a state agency is more than 90 days late on required PERS payments, the law directs where payment comes from. For Executive Department entities, PERS notifies the State Board of Examiners and, after approval, the new Reserve for Statutory Contingency Account pays the delinquent amount. For Judicial entities, PERS notifies the Office of the Court Administrator and, after the Interim Finance Committee approves, the Contingency Account pays. For Legislative entities, payment comes from the Legislative Fund. These steps help keep employee pension contributions whole.

Withholding local and school aid for pensions

When a local government is over 90 days late on required pension or benefits payments, state officials are notified. After a hearing, the State Treasurer can withhold the local government’s next state distributions until the delinquency is paid, except money needed for timely payments to protected holders. If a school district or charter school is over 90 days late and PERS notifies the Superintendent, the state deducts that amount from the school’s apportionment. Withheld or deducted funds are sent to PERS or the Public Employees’ Benefits Program. This protects workers’ pensions but can reduce cash available to local governments and schools.
