AN ACT relating to public works; providing a declaration of legislative intent regarding the payment of prevailing wages to workers employed by a contractor or subcontractor to perform construction work on certain projects awarded by a public utility; requiring, with certain exceptions, a contractor or subcontractor who is awarded a contract for construction work on certain projects by a public utility to comply with prevailing wage provisions applicable to public works when the construction work does not qualify as a public work; and providing other matters properly relating thereto.

Some utility projects must pay prevailing wages

The law makes some utility construction projects follow Nevada’s prevailing wage rules. It applies when the work is not already a public work. Covered projects are gas pipeline replacements approved in a state plan (NRS 704.991) and new electric plants of at least 50 megawatts approved in a state plan (NRS 704.741). Electric utility contracts are exempt if the main construction work is done by a contractor under a union, project labor, or worksite agreement that covers the project or its maintenance. Starting Oct 1, 2025, this applies only to contracts signed on or after that date.
