Rainy Day fund deposits, cap, withdrawals

Beginning July 1, 2025, the state makes set deposits to the Rainy Day fund each year: 40% of the unrestricted year‑end balance after keeping 7% of prior‑year appropriations, plus 1% of the year’s anticipated revenue. The fund cannot exceed 26% of the prior year’s General Fund appropriations. At the end of each quarter, up to 10% of last quarter’s Rainy Day balance, capped at $500,000, is transferred from the General Fund to the Disaster Relief Account. If state revenues are 5% or more below anticipated biennial levels, or a fiscal emergency is declared, money can be moved to the General Fund after review by the State Board of Examiners and action by the Interim Finance Committee. The Legislature may also allocate Rainy Day money directly for other purposes.

Earlier, clearer state budget process

Beginning July 1, 2025, agencies and the Budget Division follow earlier, clearer budget steps. By October 15 in even‑numbered years, lawmakers get computerized files with last year’s actuals, current‑year work programs, and each agency’s two‑year request with adjusted base, continuation costs, and any changes. By December 31, they get each agency’s adjusted base by program and statewide cost ranges to keep government and public education at current service levels. The law defines an “adjusted base budget,” removing one‑time items and annualizing ongoing costs. The Chief must use Economic Forum revenue projections, prepare the final two‑year budget for the Governor, submit it to the Legislature at least 14 days before session with a separate analysis of new programs and revenues, and by day 19 the Governor must submit needed bill recommendations and may appear before appropriation committees. The Chief also prepares the statewide cost allocation plan each year under federal rules.
