AN ACT relating to consumer protection; clarifying the authority of the Attorney General with respect to bringing certain actions relating to deceptive trade practices; revising certain civil penalties relating to deceptive trade practices; revising the authorized uses of money in the Consumer Protection Legal Account in the Office of the Attorney General; clarifying when the Consumer's Advocate of the Bureau of Consumer Protection in the Office of the Attorney General has custody or control of certain records; making certain records, files and communications of the Consumer's Advocate confidential; and providing other matters properly relating thereto.

Stronger Attorney General action on scams

Beginning July 1, 2025, the Attorney General can bring civil and criminal cases for deceptive trade practices. The Attorney General can sue for the State or for Nevada residents, including as a class representative. Courts can order restraining orders, injunctions, restitution, disgorgement, damages, and civil penalties. The Attorney General can issue subpoenas and take sworn testimony to build cases.

Consumer Advocate records stay confidential

Starting July 1, 2025, the Consumer’s Advocate has custody of a record only after receiving it from a state agency. Records that were confidential stay confidential when the Consumer’s Advocate receives them. Nevada’s public-records law now references these rules when deciding if a record is public.

More funds for consumer protection

Starting July 1, 2025, after money reverts from the administrative account, 50% goes to the Attorney General or the Consumer’s Advocate. That money can pay needed staff and other work to protect consumers and prevent fraud.

Higher fines for deceptive practices

Beginning July 1, 2025, administrative fines for deceptive trade-practice violations increase. After an administrative hearing, the Director may charge up to $15,000 per violation or three times the restitution amount ordered, whichever is more. The fine also applies if the person fails to appear after proper service.
