Civil fines for crimes against seniors and vulnerable adults

A person convicted of listed crimes against an older person (age 60+) or a vulnerable person must pay a civil fine. The fine is $5,000–$20,000 for a first conviction, and $10,000–$30,000 for later convictions. The Attorney General brings a civil case to collect the money. Collected money is split equally between a victim compensation fund and the state unit that investigates and prosecutes these crimes. This applies to offenses committed on or after the law’s effective date.

More prison time for targeting seniors and vulnerable adults

The court must add extra time when a crime is against someone age 60+ or a vulnerable person. For misdemeanors, the judge adds an extra county jail term equal to the usual term. For felonies, the judge adds 1 to 20 more years in state prison. The added time runs after the main sentence and cannot be longer than it. Judges must weigh the facts, prior record, victim impact, and any mitigation.
