You cannot combine a challenge to your conviction or sentence with a challenge to how your time was counted in one petition. The court decides the conviction-or-sentence claim and dismisses the time-count claim without prejudice, so you can refile it. Petitions filed before this law takes effect stay under the old rules. The law takes effect upon passage and approval.

Where to file time-served habeas petitions

If you are incarcerated in Nevada when you file, you must file in the district court for the county where you are held. If you were released and live in Nevada, file in the district court for the county where you live. If you are outside Nevada (in custody or living) on a Nevada sentence, file in the First Judicial District Court in Carson City. If you file in the wrong county, the clerk keeps your original filing date and must transfer it to the right court.
