AN ACT relating to criminal procedure; authorizing a court to waive the requirement that the Division of Parole and Probation of the Department of Public Safety make a presentence investigation and report under certain circumstances; providing that a failure by the Chief Parole and Probation Officer to submit a presentence investigation and report before a sentencing hearing is not grounds for an order of contempt under certain circumstances; revising requirements relating to the disclosure of a presentence investigation and report to a defendant; and providing other matters properly relating thereto.

Faster sentencing if report waived or late

Beginning July 1, 2025, a judge can accept a signed deal by you and the prosecutor to skip the Division’s presentence report. After the court or county clerk asks for a report, the Division has 45 days to submit it. If the report is not filed within 45 days, the court may still grant probation without it. These rules speed sentencing when both sides agree or when the report is late.

Judge training and narrow no contempt rule

Beginning July 1, 2025, courts must make sure judges get training on using presentence reports. Training includes behavioral health and intellectual or developmental disabilities. Also, if a required psychosexual evaluation report is not received at least 3 days before sentencing, the Chief Parole and Probation Officer’s failure to submit the presentence report is not grounds for contempt.

Shorter notice and proof for gang claims

Starting July 1, 2025, the Division must share the presentence report facts at least 7 calendar days before sentencing, down from 14. The defendant may choose to waive the 7-day minimum. If the report says the defendant is in a gang and the Division reasonably believes the defendant disputes that, the Division must include the documents it used, including field interview cards.
