AN ACT relating to securities; creating the Fund for the Compensation of Victims of Securities Fraud and prescribing the use of money in the Fund; authorizing certain persons to whom a court orders restitution to apply for compensation from the Fund; requiring the Administrator of the Securities Division of the Office of the Secretary of State to review applications for and award compensation from the Fund; making confidential certain information; requiring the Division to adopt regulations relating to the administration of the Fund; requiring the Administrator to submit to the Legislature a biennial report concerning the Fund; requiring a person who receives compensation from the Fund to reimburse the State for such compensation under certain circumstances; revising provisions relating to certain exempt securities and exempt transactions; revising provisions governing the deposit of certain money received by the Division or the Administrator; and providing other matters properly relating thereto.

Compensation and payback rules for fraud victims

Starting January 1, 2026, Nevada offers cash from a new Fund to people with a court‑ordered securities‑fraud restitution award. You must apply within 12 months of the restitution order; the Administrator can extend for good cause. Awards are capped at the smaller of $25,000 or 25% of your unpaid restitution. The Administrator reviews your application, may ask for documents, and you can appeal a denial. Your application details are confidential and not public records unless you or a court allows release. If you later collect restitution, you must tell the Administrator and repay the Fund up to your award, minus attorney fees and costs.

How the victim fund keeps its money

Starting January 1, 2026, interest and earnings on the victim Fund stay in the Fund. The Division can accept gifts and grants for the Fund. Any money left at year end stays in the Fund and carries forward. Most other Division money goes to the State General Fund, but money the law assigns to the victim Fund stays there.
