Stronger help and privacy for seniors and people with disabilities

The Attorney for the Rights now gives advocacy, education, and legal help to older people and people with disabilities. The office reviews policies, investigates abuse and neglect, and can subpoena records about those cases. It can represent an incapacitated person until a guardian is appointed. Records from counseling or representation by this office are confidential. They can be released only by a court order or under NRS 239.0115.

Clearer disability definitions and hospital-to-home help

People who meet the NRS 435.007 definition of a developmental or intellectual disability are treated as having a developmental disability for state services. The hospital-to-residence program now uses these same definitions and also counts physical disability under NRS 427A.1222. An older person in that program is still defined as age 60 or older. These updates can change who qualifies for help moving from hospital to home.

Disability rights office renamed; contracts continue

The state renames the Attorney for the Rights office to use “Developmental Disability” instead of “Related Condition.” The Governor appoints the Attorney for a 4‑year term; the Attorney must be a Nevada‑licensed lawyer and can be removed for inefficiency, neglect, or malfeasance. All existing contracts, grants, and actions remain valid and carry over to the renamed or successor office. The law takes effect upon passage and approval.
