AN ACT relating to motor vehicles; expanding to certain employees of the Department of Motor Vehicles the authority to inspect vehicles to determine rightful ownership or possession; authorizing certain employees of the Department to apply for certain court orders and complete necessary affidavits for such orders; prohibiting a person from tampering with a device for the control of emissions of a motor vehicle or removing such a device from a motor vehicle; prohibiting a person from possessing an electronic device capable of tampering with a device for the control of emissions of a motor vehicle; providing penalties; and providing other matters properly relating thereto.

No tampering with car emissions

Tampering with or removing a car’s emissions device is illegal. That includes engine swaps. You also cannot possess an electronic tool that can tamper with emissions controls. Only licensed inspectors at authorized stations can issue proof of emissions compliance; fake or unauthorized proof is illegal. Swapping to an electric motor is allowed, and swapping to a different engine is allowed if that engine’s emissions device works. Violations carry penalties.

Expanded checks to find stolen cars

Specialized law officers and DMV investigators can check VINs, titles, and registrations to spot stolen vehicles. They can inspect on highways, at repair shops, dealers, salvage pools, terminals, parking areas, and similar sites. They should work during normal business hours and avoid disrupting business. They cannot enter privately owned terminals or parking facilities without the owner’s or an agent’s permission.

Faster court orders for call tracing

District courts can issue orders to capture dialing and routing data (not call content) using pen registers or trap-and-trace devices. District attorneys, the Attorney General, or peace officers—including DMV officers with peace-officer powers—may apply with the sworn affidavit federal law requires. Courts may accept faxed or electronic signatures and use secure electronic transmission for applications and orders. The Nevada Supreme Court may set rules for this system. Public utilities that in good faith follow a court order to install these devices are not civilly or criminally liable.
