The law repeals the 2024 rule that let doulas be in the operating room during a cesarean birth. Birthing parents are no longer guaranteed a doula in the C-section operating room. Hospitals are not required to allow a doula in the operating room.
Maternal health care facilities must tell patients they can have a doula during delivery and during inpatient care after birth. They must post this on websites, in lobbies, and in waiting rooms. The Department of Health provides printed pamphlets in plain language. Pamphlets are in English and the six most common non-English languages in New York, based on the latest census, and must be available in each patient waiting area.
