Safer AI companion rules for minors

Starting January 1, 2027, operators cannot provide unsafe AI companion features to covered users under 18. For adults, operators must use age-check methods allowed by New York rules; when those rules are not in effect, they must offer multiple reasonable methods, including one that avoids government ID or allows anonymity. Operators may rely on self-declaration only when a user says they are a minor. They may use age-check information only to determine age and must delete it after the attempt, unless law requires keeping it; limited customer-service, research, and business uses are exempt.

New York can enforce AI safety rules

Starting January 1, 2027, the New York Attorney General can seek court orders, restitution, damages, and other relief for actual or threatened violations. The Attorney General can also seek penalties of up to $25,000 per violation. Courts must hold affiliated companies jointly and severally liable when they purposely and unreasonably structure their businesses to avoid liability and frustrate recovery; contract terms cannot block or burden enforcement. The law covers conduct occurring partly or fully in New York, but not conduct involving a user physically outside the state.
