By September 1 each year, ESCOs must publish a notice of unclaimed property and say where to see a list. They must keep a list of names open to the public at their main office where payment is due, and file an affidavit with the State Comptroller by September 10. By October 10, they must send the Comptroller all amounts deemed abandoned as of July 1, plus a true, detailed report. Reports list names, last known addresses, amounts, key dates, and other details the Comptroller requires. This helps you find and claim any money owed.
The law treats energy service companies like utilities for unclaimed money. Your deposit, prepaid amount, or ordered refund is abandoned after two years. The two years runs from when service ends (or the later end if service restarted) or from when a refund became payable. The State Comptroller takes custody, and you can file a claim to get the money back.
