Bill Overview

Analyzed Economic Effects

3 provisions identified: 3 benefits, 0 costs, 0 mixed.

Easier nonhospital DNR/DNI orders, no bracelets required

Nonhospital do-not-resuscitate orders must use a standard state form. You may wear a bracelet or other item to show the order, but no one can require it or tie care to it. The Health Commissioner can approve alternate DNR and do-not-intubate (DNI) forms. Forms for people with developmental disabilities or mental illness who cannot decide, or who have a guardian, need approval from the right commissioner. These alternative forms can be used in hospitals and residential health care facilities. The act also removes one related subsection from the statute.

Notify parents before life support for emancipated minors

Hospitals must tell the parents or guardian when they can reasonably find and contact them. They must record the notice in the medical record. This happens before the hospital withholds or withdraws life-sustaining treatment for an emancipated minor.

More people can take care disputes to court

More people can start a special court case over health care decisions. A health care provider, a legal guardian, family members, a close friend, or the state health, mental health, or developmental disabilities commissioners can file. A court can then resolve the dispute.
