The law requires every nonpublic school to keep AEDs on site in each instructional building. State education and health leaders set how many and what type. Schools must test and maintain AEDs to maker and agency standards. Schools must tell the regional EMS council where their AEDs are. A sign at the main entrance must show where the AED is kept. These rules start July 1, 2026, and state agencies can issue rules before then to put this in place.
At any school event, at least one trained staff member must be present to use an AED. For school athletic contests held off site, the school must make sure an AED is at that location. Only people who finish an approved AED course may operate one at school, unless they are licensed health workers or good‑faith bystanders who are not seeking pay. Using an AED under this law counts as first aid and is not unlawful professional practice, and Good Samaritan protections apply. Every AED use must be reported to local EMS or dispatch right away. These rules take effect July 1, 2026.
