School districts outside cities of 125,000+ people can leave out some state‑aided school building debt when counting their legal borrowing limit. The education commissioner must estimate that state building aid will cover the interest and yearly payments on that debt. The estimate must describe the debt and is only good until the next June 30. The commissioner sets the application format, and the Education Department gives three certified copies of the estimate at no charge. Districts must attach a certified copy of the estimate to the debt statement they file and may deduct the allowed excluded amount there.
Local school districts can also leave out part of debt for fallout shelter projects when counting borrowing limits. This applies to shelters built under the state defense emergency law. The excluded amount is capped at $50 multiplied by the planned number of people the shelter can hold. Any debt above that cap still counts toward the limit.
