Bill Overview

Analyzed Economic Effects

3 provisions identified: 1 benefits, 0 costs, 2 mixed.

No retaliation and fines for violators

Your employer cannot fire, threaten, punish, or discriminate against you for using your file-access rights. Retaliation includes threatening to contact immigration authorities or reporting your or your family’s status. The New York Attorney General enforces these rules. Violators can be fined $500 to $2,500.

Workers get access to personnel files

You can get a free copy of your personnel file within five business days after you send a written request. Your employer must tell you within ten days after adding anything that could hurt your job, pay, promotion, or lead to discipline. You may review your file on-site up to two times each year, and a review after a negative-entry notice does not count toward the two. If you disagree with an item, you can add a written statement; if the item is shared, your statement goes with it. You can try to remove entries the employer knew were false, or you and your employer can agree to remove items. The law defines what counts as a personnel record, including job title, pay rate, evaluations, warnings, and termination notices, and it excludes material that would clearly invade someone else’s privacy. Employers keep your record from your start date until three years after you leave.

Union contracts and workplace policy rules

If your union contract already gives you access to personnel files that is at least as good as this law, the contract controls. If an employer keeps a written personnel policy, the current version must be kept and updated at the office that handles personnel.
